The best way foreigners can safely invest in property or buy land in Lombok is by owning an Indonesian legal entity — a PT PMA. Properties are owned by the Hak Guna Bangunan (HGB) title. It's the best way of ownership for foreigners and it is completely firm. For many years Indonesia has decreed that land in Indonesia can only be owned by Indonesian citizens. Thus, if you want to buy a house (as a foreigner), this would have been legally impossible. As stated in this law, foreigners are only permitted to purchase land or homes under the “Right to Use” (Hak Pakai) title. Hak Pakai is known leasehold 1:48 Hak Milik is Freehold. Therefor, the solution of founding a company and transfer the land under the HGB is the choice to go.
The answer is no, as the transactions are processed by our company and into your account. For that we rely on a trustedinternational bank. But opening an Indonesian bank account could be worth considering due to tax advantages.
We, the company, absorb the responsibility and pay 20% tax on the ROI pad out. The ROI the investor receives does not fall under Indonesian tax regulations and is only declared as revenuein one’s own country.
You are entitled to the ROI for the contract length depending on your package and ownership. All seeable in the contract and Exposé.
Your investment will be treated by us - PT. Jaringan Lombok Investment in the form of a legally registered company. We work with state-verified notaries and a registered tax advisors. The registered PT. Jaringan Lombok Investment acts as a legal entity and is protected by Indonesian law.
There is always a risk on overseas investments. We considered every aspect for a lot of years. We made up the decision that the major indicators are playing in the favour of investors. Thus, for us the answer is YES! Especially as President Jokowi was recently re-elected. Indonesia revoked thousands of regulations, which were hindering investments. Tt has issued 12 economic stimulus packages in less than 18 months, amongst other initiatives, specifically designed to encourage investments. The country relies on tourism and investments from foreigners. Their goals are clearly aiming to make Indonesia a safe and reliable country for investments.
